Does a father have parental rights and responsibilities in relation to his child?

Yes – If the father is married to the mother.  If he is not, provided his name is on the child’s birth certificate and the child was born after 6th May 2006, the father has full parental rights.

At what age can my child(ren) decide for themselves where they want to live?

At the age of 16 a child in law becomes an adult. She/he can make all decisions for themselves at that age.  Below the age of 16 account will be taken of the view of a child so far as practicable if the child wishes to express them.  A child of 12 years of age is presumed to be of sufficient age and maturity to form a view.  However it must always be remembered that in any Court proceedings the view of the child will not be determinative of the outcome of the case.
